These terms cover the Quiz Bowl Scoreboard iOS app and the quiz-bowl-scoreboard.web.app website (together, the “Service”), operated by Sean Mooney, an independent developer (the “Operator”). By using the Service you agree to these terms. If you do not agree, do not use the Service.
The iOS app is distributed through Apple's App Store, and your download and license of the app itself is additionally governed by Apple's standard Licensed Application End User License Agreement; these terms supplement it and govern your use of the streaming service and website. Apple is not a party to these terms and is not responsible for the Service.
All scores, statistics, and win-probability figures shown by the Service are preliminary and unverified, entered live by scorekeepers using the app, and may differ from actual or official results. The Service is not an official record of any competition and the Operator makes no representation as to accuracy.
You must be at least 13 years old (or the minimum age of digital consent where you live) to stream games through the Service. Scorekeeping and streaming are intended for adult coaches, staff, and volunteers; if you are under 18, stream only with the permission of a parent, guardian, or supervising coach.
Entering player names is optional. If you choose to enter or publish player names, you agree that you will:
You are solely responsible for all content you enter into the Service, including team names and player names. The Operator does not review, verify, or moderate the content users publish.
By streaming a game you grant the Operator a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and publicly display the content you enter (team names, player names, and scores) for the purpose of operating the Service, including live display and replay, until the game or content is deleted.
Games streamed with “List in public games” enabled appear in a public directory. Unlisted games are accessible to anyone who has the game link. Treat anything you stream as public. When you stream, the Go Live screen shows a player-names switch: it is preset off for publicly listed games and on for unlisted (link-only) games, and you can change it before or during the game.
The app provides tools to (a) turn off player-name sharing at any time, including during a live game, (b) remove player names from any past streamed game while keeping its scores, and (c) permanently delete a streamed game. Name-removal requests from a player, parent, or guardian — and deletion requests from the scorekeeper who created a game — can also be sent to the contact address below; the Operator will make good-faith efforts to act on legitimate requests as quickly as reasonably possible. You agree not to use the Service to publish unlawful, harassing, or deceptive content, to impersonate others, to interfere with the Service's operation, or to attempt to access data you do not own. The Operator has no obligation to monitor content, but may remove or disable any game or content, suspend any device's access to streaming, or modify, suspend, or discontinue all or part of the Service at any time, with or without notice, including for suspected violation of these terms.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability.
To the maximum extent permitted by law, the Operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, arising from your use of the Service or from content published by users. To the maximum extent permitted by law, the Operator's total liability for any claim relating to the Service will not exceed the amount you paid for the app (if any) or ten U.S. dollars (US $10), whichever is greater.
You agree to indemnify and hold harmless the Operator from claims, damages, and reasonable expenses (including attorneys' fees) arising from content you enter or publish through the Service, your breach of these terms, or your violation of any law or of any third party's rights (including privacy or publicity rights).
These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws principles. Any dispute arising from the Service must be brought exclusively in the state or federal courts located in Williamson County, Tennessee, except that either party may bring an eligible claim in small-claims court. Before filing any claim, you agree to contact the Operator at the address below and attempt to resolve the dispute informally for 30 days. To the maximum extent permitted by law, you and the Operator each waive the right to bring or participate in any class or representative action; claims may be brought only on an individual basis.
If any provision of these terms is held unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in full effect. These terms are the entire agreement between you and the Operator regarding the Service. The Operator's failure to enforce any provision is not a waiver of it.
These terms may be updated from time to time; the “Last updated” date above will change when they are. Continued use of the Service after an update constitutes acceptance of the revised terms.
Streamed games are stored in Google Cloud Firestore on servers located in the United States; the website is served by Firebase Hosting. Google acts as a service provider (processor); see Firebase's privacy documentation. Like most online services, Google's infrastructure transiently processes technical data such as IP addresses and request logs to deliver and secure the Service; the Operator does not access or use this data to identify anyone.
The Service is not directed to children under 13. Scorekeeping and streaming are intended for adult coaches, staff, and volunteers; viewing a game page requires no account and collects no personal information from viewers of any age. The Operator does not knowingly collect personal information from children: any player names shown were entered by the scorekeeper who streamed the game, who agrees under the Terms of Use to use first names or nicknames only and to have permission to share them. Player names do not appear in the public games directory or in the site's team search — they are visible only on individual game pages.
If you are a parent or guardian and want a name removed from a streamed game, contact the address below with a link to the game page and the Operator will make good-faith efforts to remove it as quickly as reasonably possible. If the Operator learns that personal information has been collected directly from a child under 13, or that a streamed game identifies a child beyond a first name or nickname, the Operator will delete that information.
Streamed games remain available for replay indefinitely — they are not automatically deleted. The scorekeeper who created a game can, at any time, delete it or remove its player names while keeping the scores, using the in-app tools; deletion or name removal can also be requested by email as described above. The Operator may also remove games as described in the Terms of Use. Data on your device can be cleared by deleting the app.
